Making A Purchase

The total cost of your order reflects the price of the items ordered excluding the shipping charge for handling, packing and postage. All products are priced in pounds sterling (£), and include VAT. Delivery charges are calculated based on the total weight of your order and your delivery location.  Additional surcharges are required for shipping to certain areas (See Estimated shipping times below).

We accept payment through both Secure Trading and Paypal, which are both fully secure payment sites. Once you have made your payment you will be returned to the shop order confirmation page and be given an order number.

Every effort is made to ensure that the prices shown on our website are accurate at the time you place your offer. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you choose to cancel your order, we will refund you any sum that has been paid by you for the goods.

When you place an on-line order for the products you have put in your "shopping basket", you are accepting to buy them at the price and according to the terms of this website. We will send you an email to say we agree to sell them and to confirm that we are able to deliver. If we do not accept your order for any reason, we will tell you as soon as possible. We have the right to choose not to accept any order. You can only order using this website at the prices and terms which are set out on this website.

 

Order acknowledgment

When you have completed your order you will be redirected to an order confirmation page. This page will detail the product(s), the cost (including VAT, postage and packaging) and delivery specifications. Please inform us immediately if you notice any errors on the order. You will also be sent an acknowledgment email confirming that the order is being processed.

 

Contract

A legally binding contract between you and us will be formed when we email you to confirm that your order has been accepted and that we have shipped the goods to you. This email represents our acceptance of the offer you made to purchase the goods when you completed your order. If we confirm to you that some but not other products that you have ordered have been shipped, those goods that have not been shipped will not form part of our contract with you. In the event of any change between completion of your order and contract formation, we will inform you and you will at that point have the right either to accept the change (in which case your email reply will represent a new offer, which we will accept upon notification of shipment) or reject the change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).

 

Shipping And Handling

Delivery for your order will be calculated at the checkout. You can find full details of all our delivery charges here.

Estimated delivery time: 1-3 working days (Subject to stock availability) Orders will be placed on a 1-3 day standard dispatch.

All order over 99 kilos will be delivered on a pallet on a tail lift vehicle so that order is able to be unloaded.

For items that are made to order or out of stock, please contact us for estimated delivery times on these products.

Your order will be delivered to the delivery address you supply. All delivery times quoted above are estimates only, based on availability, processing and postage time.

Please note that every effort is made by us and our partners to deliver your order within the specified time, however there may be occasions when we are unable to deliver your order within the specified time. In such circumstances we will endeavour to contact you in order to advise you of the situation.

Please note that no claim for compensation will be considered for any consequential losses incurred as a result of late delivery.

Where an item has been withdrawn due to becoming obsolete, discontinued or otherwise unavailable, we will inform you immediately and offer an alternative/substitute if one is available. A refund will be offered if a substitute is not available. In the event that any of the goods you have ordered are currently unavailable, we will ship the available ones to you and the remainder as soon as we receive them. If this is the case, we will inform you on the delivery note. We make every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors.

Weir & Carmichael Ltd and/or the Directors of Weir & Carmichael shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

 

Payments

We check your payment card details when we process your orders. Your account will be charged at the same time. If your order is cancelled before delivery, we will refund the full amount that you paid for the order to your payment card. We can process payments from Mastercard, Visa, and Switch cards. For security reasons, we do not store payment card details. This means that you will need to re-enter your card details each time you place a new order. You do not however need to use the same card each time. Due to the nature of the clearing system, your credit card payment WILL be taken at the point of ordering. If a problem should occur in relation to our ability to either supply the goods to you or to deliver them to you, we will inform you that this is the case and give you the option to either receive a full refund for the amount paid, or alternatively, if it will be possible, to have the goods delivered to you as soon as possible.

 

Returns Policy

In the case that the goods that are faulty, damaged or incorrectly supplied, please contact us by email at info@weirbags.co.uk within seven working days and we will ask you to return the goods to the following address:

If, for any reason, you are unhappy with the item you have purchased simply return it to us in its original condition and sealed packaging, within 30 days of receipt and we will issue a full refund for the price you paid for the item. It is your responsibility to get the item back to us. We will only refund postage costs incurred in returning faulty, damaged or wrongly supplied goods. We shall use reasonable efforts to replace damaged or incorrect goods, but if replacement is not possible, or if an order is cancelled for any other reason, we will only be obliged to refund the full amount paid by you. This does not affect your statutory rights.

Please note it can take up to 10 days to process a refund once the item arrives back with us at our head offices.

 

Cancellations

You may cancel an order within 24 hours of the order being made and paid for. Should you wish to cancel the order thereafter, it must be returned by you in perfect condition within 7 days of delivery (please see Returns policy above).

 

Warranties

If you are buying goods for your own personal use and not in the course of a business, certain conditions relating to the quality of the goods are incorporated into the contract between us by law. Nothing in this website affects any of your rights which cannot, by law, be taken away from you. If you are not buying the goods for private use, those terms relating to product quality shall not be part of the contract between us. The only terms to be included in the contract between us are those contained or referred to in this website. We do not offer or agree to any other conditions, warranties, guarantees or representations about the quality or description of the goods we supply.

Where you purchase the goods as a Consumer the goods we supply will be of satisfactory quality. Weir & Carmichael Ltd will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

  • There is no breach of a legal duty of care to you by us or by any of our employees or agents;
  • Such loss or damage is not a reasonably foreseeable result of any such breach;
  • Any increase in loss or damage results from a breach by you of any term of this contract.

Nothing in these terms affects any liability for death or personal injury caused by a breach of a legal duty of care by us or for fraud or your statutory rights as a consumer.

Where you purchase the goods from Weir & Carmichael Ltd other than as a Consumer the goods that we supply will be of satisfactory quality but, Weir & Carmichael Ltd liability in respect of any breach of these Conditions and/or any representation, statement or tortuous act or omission including negligence arising under or in connection with the Contract shall be subject to the following:

All other warranties conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law, excluded from the contract.

Weir & Carmichael Ltd’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the performance of contemplated performance of this Contract shall be limited to the contract price.

Weir & Carmichael Ltd shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this contract.

Nothing in these Conditions however shall exclude or limit the liability of Weir & Carmichael Ltd for death or personal injury caused by Weir & Carmichael Ltd's negligence or for fraudulent misrepresentation. In the case of disagreement, both Weir & Carmichael Ltd and you agree that the contract shall be governed by and that they will submit exclusively to the laws of England.

 

Data Protection

We will keep a record of your contact details for the purpose of shipping the order. We will never make your personal details available to other companies for marketing purposes.
